1. Acceptance of Terms

By accessing or using Amazing AI Radio ("the Service"), operated by Amazing AI Radio ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service.

2. Service Description

Amazing AI Radio is a digital platform that enables artists to upload, stream, and share music — including AI-generated music — with listeners worldwide. The Service includes free and paid subscription tiers. We do not guarantee uninterrupted or error-free availability of the Service.

3. User Accounts

To upload content or subscribe to a paid plan, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep it up to date.

4. Subscriptions and Billing

  • Free Plan: Includes 1 artist profile and 1 track upload at no cost.
  • Paid Plans: Paid subscriptions (monthly or annual) unlock unlimited artist profiles and track uploads. Pricing is displayed on our Pricing page.
  • Billing Cycle: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Your subscription automatically renews at the end of each billing period unless you cancel.
  • Cancellation: You may cancel your subscription at any time from your account settings or by contacting us. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.
  • Price Changes: We reserve the right to adjust pricing. Any changes will be communicated in advance and will take effect at the start of the next billing cycle.

5. Payment Processing

All payments are securely processed by our third-party payment partner, Lemon Squeezy (Lemon Squeezy, LLC). By subscribing to a paid plan, you also agree to Lemon Squeezy's Terms of Service. We do not store your payment card details; all financial data is handled directly by Lemon Squeezy in compliance with applicable security standards.

6. Refund Policy

Because Amazing AI Radio provides access to digital content and services, all sales are generally final. However, we offer the following:

  • 14-Day Cooling-Off Period: If you are located in the European Union or the United Kingdom, you may request a full refund within 14 days of your initial subscription purchase, provided you have not substantially used the paid features during that period, in accordance with applicable consumer protection laws.
  • Billing Errors: If you believe you have been incorrectly charged, contact us within 30 days of the charge and we will investigate and correct any errors.
  • How to Request a Refund: Send your request to hello@amazingairadio.com with your account email and a description of the issue. Approved refunds are processed through Lemon Squeezy and may take 5-10 business days to appear on your statement.

7. User Conduct

You agree not to:

  • Attempt to reverse engineer, scrape, or download content from our Service
  • Use automated systems or bots to access the Service
  • Upload content that infringes any third party's intellectual property or other rights
  • Upload content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Distribute or commercially exploit any content from the platform without authorization
  • Use the Service for any illegal or unauthorized purpose

8. Intellectual Property

  • Platform Content: The Amazing AI Radio name, logo, website design, and all platform-generated content (including AI-generated music created by us) are owned by Amazing AI Radio and are protected by applicable intellectual property laws. Unauthorized reproduction or distribution is prohibited.
  • User-Uploaded Content: You retain ownership of any music, artwork, or other content you upload to the Service. By uploading content, you grant Amazing AI Radio a non-exclusive, worldwide, royalty-free license to host, stream, display, and distribute your content solely in connection with operating the Service. This license terminates when you delete your content or your account.
  • AI-Generated Content: Audio streams provided on the platform that are generated by artificial intelligence may not be eligible for copyright protection in all jurisdictions. Users acknowledge that the legal status of AI-generated works varies by region. Amazing AI Radio makes no warranty regarding the copyrightability of AI-generated content.
  • Listening Rights: As a listener, you are granted a personal, non-commercial, non-transferable right to stream content on the platform. This does not grant you ownership or download rights to any content.

9. Content Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or otherwise inappropriate. Artists may delete their own profiles and tracks at any time.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Amazing AI Radio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use or inability to use the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction in which Amazing AI Radio operates.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after any changes take effect constitutes acceptance of the revised Terms.
